Terms & Conditions of Service

These Terms & Conditions govern the engagement of the audiovisual services offered by CasaViva Studio through casaviva.studio. Requesting a quote or engaging any of our services implies full acceptance of these terms.
1. Purpose
CasaViva Studio provides AI-assisted cinematic audiovisual content creation services, transforming existing photographs of real estate properties into cinematic videos and visual pieces, aimed at promoting and presenting villas, apartments, vacation homes and tourist accommodation.
2. Description of the service
The core service consists of transforming existing photographs of a property into cinematic audiovisual content, generally without the need for a new photo shoot or filming session. The specific scope of each project (number of images, delivery formats, video length, social media adaptations, etc.) is agreed individually with each client and reflected in the accepted quote.
3. Work process
The typical process for each project consists of the following stages:
- Receipt of the property photographs provided by the client.
- Visual enhancement of the selected images using artificial intelligence (optimisation of light, colour and composition).
- Creation of cinematic animation and motion from the treated images.
- Final editing of the video, including pacing, transitions and music.
- Delivery of the final video to the client in the agreed formats.
4. Client responsibilities
The client represents and warrants that:
- They hold the necessary rights over the photographs provided to CasaViva Studio, or have the express authorisation of the property owner and, where applicable, of the holder of the rights to the images, for their use and processing for the purposes described in these terms.
- The data and material provided are accurate and do not infringe the rights of third parties, including intellectual property, image or data protection rights of any individuals who may appear in the photographs.
- They hold the authorisations necessary for the subsequent use of the delivered video across whichever communication and promotional channels they choose to use (website, social media, vacation rental platforms, advertising, etc.).
CasaViva Studio does not verify ownership of the rights to the material provided by the client and assumes no liability arising from the client's breach of the above warranties, without prejudice to CasaViva Studio's right to claim from the client any damages that such breach may cause.
5. Intellectual property of the created material
Once the agreed price has been paid in full, CasaViva Studio grants the client the usage rights necessary to exploit the delivered final video for promoting the property it was created for (website, social media, vacation rental platforms and related advertising campaigns).
Unless expressly agreed otherwise, CasaViva Studio retains the right to include the completed project in its own portfolio and promotional materials, and may showcase the result of the work for commercial and demonstration purposes. A client who wishes to exclude their project from CasaViva Studio's public portfolio may request this in writing at hola@casaviva.studio.
CasaViva Studio retains, in all cases, the intellectual property rights over its own techniques, processes, templates and tools used in creating the content, regardless of the transfer of usage rights over the final result delivered to the client.
6. Pricing and payment
CasaViva Studio does not publish fixed rates, as each project is priced individually based on the property, the number of images, the formats requested and the scope of work. The final price will be communicated to the client via a written quote before the project begins.
Acceptance of the quote by the client implies agreement with the price, the scope of the service and the agreed payment terms, which may include payment of a deposit before work begins and the remaining amount upon delivery of the final video, unless other specific terms are agreed in writing.
7. Revisions
Unless otherwise expressly agreed in the quote, each project includes up to two (2) rounds of revisions to the delivered edit, intended for reasonable adjustments within the initially agreed scope (for example, pacing, music selection or minor editing tweaks). Revisions involving substantial changes to the agreed scope, or additional rounds beyond those included, may incur an additional cost, which will be communicated to the client before being carried out.
8. Delivery times
Delivery times are indicated as estimates in each project's quote and depend on the complexity of the work and the current workload. CasaViva Studio will make reasonable efforts to meet the communicated timelines, which are not of the essence unless expressly agreed otherwise.
9. Cancellations
The terms applicable to a client's cancellation of a project, as well as the cases in which a right of withdrawal may or may not exist under Spanish law, are set out in our Returns & Cancellations Policy, available at Returns & Cancellations.
10. Service limitations
The result of AI-assisted cinematic treatment constitutes a visual interpretation of the original photographic material and may vary depending on the quality, resolution and characteristics of the photographs provided by the client. CasaViva Studio does not guarantee an identical result between different projects, nor that the final result will exactly match subjective expectations not reflected in writing in the accepted quote.
CasaViva Studio does not guarantee specific business outcomes (bookings, sales or revenue) arising from the use of the delivered audiovisual content, the result of which depends on numerous factors beyond the service provided.
Availability for new projects is subject to the existing workload at any given time.
11. Governing law
These Terms & Conditions are governed by Spanish law, in particular Royal Legislative Decree 1/2007, of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users, and other complementary regulations, without prejudice to any additional protection rules that may apply to clients who hold consumer status.
